Nielsen Wants Bubba’s Conspiracy Theory Tossed Again

The ratings firm says allowing Bubba The Love Sponge’s claim that Nielsen, Cox and Cox morning man Mike Calta conspired against him will not only delay the upcoming June trial against Bubba, but are also “based on fanciful conspiracy theories with no basis in fact.”

In his alleged ratings tampering case, Bubba claims the Nielsen, Cox and Calta conducted a sting operation designed to entrap him into engaging in ratings distortion activity. The original allegation Bubba filed was denied by the Judge in the case in January and Bubba filed an amended shorter version of the same allegation in February. Bubba is trying to pull Cox and Calta into the case and Nielsen says there’s no reason to do so and that is simply a delaying tactic on Bubba’s part. “Just the process of Cox getting up to speed will take months. This additional delay and prejudice to Nielsen is yet another reason to deny Defendants’ Motion.”

Nielsen says the idea that Nielsen, Cox and Calta allegedly concocted against him have no basis in fact. “Defendants’ proposed counterclaims stem from wild speculation and conspiracy theories lacking any factual support and, if permitted now, may ultimately still be dismissed for failure to state a claim. To survive a motion to dismiss for failure to state a claim, a complaint must contain enough facts to state a claim to relief that is plausible on its face.”

Nielsen also says Bubba has revealed confidential internal documents between Nielsen and subscribers Cox and Beasley, ” including gratuitous direct quotes from these confidential communications. This detail is not only irrelevant, it is not necessary to support the claims asserted in any of the proposed counterclaims.” This matter has been going on for nearly 18 months now and trial is scheduled for June 5.
