Did Klein Use The Bridge Photo Without Permission?

8

The last week has not been friendly to new Entercom morning man Kevin Klein. In fact, we’re not even sure if Klein will ever be the new Entercom morning man in San Diego. His show was scheduled to launch last week but that never happened after he posted a picture of the Coronado Bridge with the slugline, “Jump to a new morning show.” And, Entercom is not saying a word about its plans for Klein or mornings on 97.3 The Game, especially after the San Diego Padres were very critical of the station now carrying their games. The Padres wanted to wait until their first set of home games were played before deciding what, if anything, could be done about their play-by-play contract with the Entercom station.

There could be more trouble brewing for Entercom and Klein. Jesse Cuevas is the photographer that actually took the picture of the bridge. Cuevas told The San Diego Reader he was never contacted about his photo and did not give Klein permission to post it. “It’s a horrible way to use it, connecting it to suicide. I think it is a serious issue. This all has personal meaning to me. I have been told that, because it was used in this way, there is no way I could ever sell for anyone else to use.”

And so there may even be more problems for Klein and Entercom if Cuevas wants to pursue the matter. He says he has contacted Entercom’s legal department.

For now Klein has still not flipped on the microphone on the station. His bio remains on the website, however, we are hearing rumors that there may be a reconfiguration of the air talent on the station and that could be coming soon. Entercom is a very heavy sports company, they carry more play-by-play than any other radio company. It may be Entercom executives decide to smooth out their relationship with the Padres, a team they just began a new partnership with, by moving on from Klein.

  1. “Less than 25% of the original image was used and there is no reference or connection to the original work making the argument that it can’t be sold/licensed again is untrue.”

So theft is OK. And just where does it say there has to be a reference or connection to an original work, to be theft?

Go bloviate elesewhere, Green Dean. Adults have work to do.

  2. Hello.

I think I’ve cracked the current code. It’s a smear campaign by the AM radio guys and diehard sportsfans that enjoy fighting over debate compounded by executives wanting to remain safe and silent until the hype passes. Baseball players curse, spit and grab their nuts and fellow player’s butts no ones up in arms protesting over the language and mannerisms of a professional. Why? I guess because they’re doing their job and it doesn’t matter.

Suicide prevention nets on bridges is a dumb idea because you can just flop into the net and then walk over to the side again and jump. Suicide isn’t hilarious but bad jokes aren’t terminal.

Most of the more vocal hype is from out of state rubberneckers that are more concerned with baseball than a new morning comedy drive-time radio show.

RE: this – Less than 25% of the original image was used and there is no reference or connection to the original work making the argument that it can’t be sold/licensed again is untrue.

It looks a bit like like political alienation to preserve some status quo. perhaps someone needs to talk and rather than do so they’re looking for a scapegoat to divert attention. .. .maybe.

Give me a show I’ll show you how to mess it all up.

    • The fact that you’d blame anyone other than the guy who made the joke, then quadruped down on the joke is in fact….a joke.

  3. What made Kevin Klein think this was a good idea? I have to wonder because it’s something I’d never think of. If Entercom lets the clown on the air I wouldn’t be surprised if he created more problems for them. The Padres should be the least of their concerns. Don’t forget just up the road in Sacramento Entercom also gave us “Hold Your Wee for a Wii” which resulted in a lady dying.

  4. 1) those who brag about being funnier than all the rest (kevin klein)–usually aren’t.

    2) Imus, Stern, Rush–they all took the basics of trash and perfected them. none were overnight sensations.

    3) what kevin SHOULD have learned to do is step back and check his ego AND id at the door. you have the padres, right? can’t this clown partner up with the team for, say, a children’s cancer mini-radiothon that raises money, gets his name, face and voice out there in a positive way and strokes the station’s new number one client. six months from now, kevin could lash out. but not now. instead; he thought with his ‘other’ head. all that’s left is for the attorneys to negotiate an exit deal. seriously. what a fool.

  5. Really? So this guy is not only stupid but guilty of stealing the photo he published in his tasteless tweet?

And still no statement from Entercom who clearly is more concerned with saving their contract with The Padres than addressing this situation and attempting to find a resolution.

Shameful, unprofessional behavior across-the-board from DJ to corporate.

What personal behavior gets you fired at Entercom anyway?

Can this disaster get any worse?
    In a word … ‘yes.’
