In his fight with Nielsen, Bubba The Love Sponge had been challenging Nielsen’s claim that certain documents were confidential. On Friday, United States District Judge James Whittemore denied Bubba’s request to have those documents available for the public to see. The judge ruled that “challenging a confidentiality designation is not the proper procedure for a court to decide whether the public has a right to access a pleading.”
