SiriusXM To Settle Pre-1972 Suit For $100 Million

The satellite company has agreed to settle a copyright lawsuit brought by Flo and Eddie of the Turtles for songs it played that were recorded before 1972. Pre-1972 sound recordings are not protected by federal copyright.

Sirius agreed to pay between $25 million and $40 million for past royalties, depending on the outcomes of other litigation, in three states (New York, Florida, and California). SiriusXM also entered into a 10-year license agreement that could be worth between $45.5 million and $59.2 million.

The proposed settlement requires approval by U.S. District Judge Philip Gutierrez in Los Angeles. A hearing on the motion for preliminary approval is set for Jan. 30.
