Radio Ink has confirmed that WBAI local programming is back on the air on the order of Pacifica Foundation CEO John Vernile. He had to comply with the Wednesday’s court order, even though Pacifica’s believes what was ordered was a violation of federal and state law. Pacifica also confirmed to Radio Ink that it does plan to appeal the ruling from Judge Crane

Despite the fact that the station cannot sustain itself, The New York Post is reporting that Manhattan Supreme Court Justice Melissa Crane said Wednesday “I think it’s time to get WBAI back on the air and back to fundraising.”
Local employees and the Pacifica Board of Directors have been fighting each other over the programming at the station. The employees were fired after the Board determined the station was hemorrhaging cash and draining the company of funds. Local employees took the matter to court and it appears they’ve won the latest battle. And while the judge says the radio station should get back to fundraising there’s no indication how all the unpaid bills would be taken care of.
WBAI had been on the air since 1955. In early October the local feed was pulled for Pacifica’s National programming.
