In the back-and-forth battle between Bubba The Love Sponge and Nielsen, Bubba has filed a new counter-claim against the ratings firm over allegations he tampered with ratings. Bubba claims Cox demanded Nielsen pressure Beasley to fire in Tampa. And if Nielsen did not implement the “death penalty” sanction, Cox threatened to file a lawsuit against Nielsen, seek an MRC audit and Congressional inquiry into Nielsen’s PPM data collection adequacy.
Bubba has been claiming that Cox conspired with Nielsen regarding the ratings tampering charges and Nielsen put pressure on Beasley to fire him in Tampa. In the latest filing, Bubba claims “Nielsen imposed additional pressure on Beasley to terminate its relationship with Clem. Specifically, on October 6, 2016, Nielsen notified Beasley that it deemed certain on-air comments made by Clem expressing his disappointment with recent audience estimates to be of serious concern. This was highly unusual as similar comments are commonly expressed by radio show hosts throughout the country. Nielsen later notified Beasley that it intended to, and in fact did, note on the special notices page of the October 2016 Tampa-St. Petersburg-Clearwater ratings report and eBook the comments broadcast by Clem.”
Bubba claims that Nielsen and Cox undertook actual and overt actions in this conspiracy. And, Bubba claims, that as a result of Nielsen and Cox’s malicious and unlawful actions, and their agreement and conspiracy to commit said actions, Clem and BRN have suffered and will continue to suffer damages in an amount to be proven at trial.
Thursday morning Nielsen sent Radio Ink the following statement: “These latest claims are entirely without merit and Nielsen intends to vigorously defend against them.”
A trial is expected to be held in June.
