Judge Rules Against Cumulus in Non-Compete Case

This goes back to a story we reported on March 25. Cumulus filed a lawsuit against Amanda Rollen and Hoosier AM/FM, which operates five radio stations in Marion and four in Kokomo. Cumulus owns New Castle radio station WMDH-FM (NASH-FM 102.5). Cumulus alleged Rollen signed a “non-compete” agreeing not to work at any station “within a 50-mile radius” of NASH-FM’s transmitter for six months after leaving the New Castle station. The Star Press reports Delaware Circuit Court Judge John Feick denied Cumulus Radio’s request for an injunction to keep Rollen off the airwaves.

According to The Star Press, Feick said Cumulus produced no evidence of any monetary losses, or an impact on ratings, as a result of Rollen’s work for the Marion and Kokomo stations. Feick wrote that “any proposed harm perceived (by the New Castle station) by Amanda Rollen operating at her current location is speculative at best.” The judge also noted Rollen’s supervisor at NASH-FM, Chris Green had told her he was “not concerned with any production activities carried on by (Rollen),” although “it was his desire she not have any on-air activity for the six-month period.”

  1. Cumulus is facing a ton of these suits, many are just being filed and waiting either Arbitration or Mediation. Let the Cumulus Board see what senior leadership is focused on, ripping off personalities and further spending money to defend the position. Richard Denning, Cumulus’ Chief Counsel and Board Member, is so out of touch with the current sentiment of judge’s and arbitrators; they are no longer impressed by a publicly traded corporation, conversely, they are eager to punish these crooks for even attempting to deny someone the ability to put food on their table.

  2. Talent, when it is desperate work, will sign anything – even when it skirts the boundaries of ethic, morality and legality.
    Maybe there is a clause that reads: “And you’ll never have lunch, take a meeting or work in this town again.”

  3. Remember when your word was your bond? Now, apparently, even your signature isn’t worth the paper it’s written on.

    • Seriously? You think it’s ok to not pay someone and keep them from working for six months? You sound like a rich person who likes the good old days.
