2016 Big For Radio And ASCAP, BMI, SESAC

In his latest blog, Broadcast Attorney David Oxenford reminds the radio industry that this year is a big one for radio, represented by the RMLC, and performing rights organizations ASCAP, BMI, and SESAC. He says both the ASCAP and BMI agreements expire and if new deals cannot be reached, there is the potential for rate court litigation over the proper royalty amount.

The royalties radio pays now are based on a percentage-of-revenue model. For some time, broadcasters were paying a flat fee based on market size. Oxenford also writes about the Department of Justice review of the antitrust consent decrees under which ASCAP and BMI operate. And he says a new issue could pop up, “A new PRO, Global Music Rights, has been formed to represent the interests of certain songwriters and music publishers. This year, songs written by artists including members of the Eagles as well as John Lennon and Pete Townshend, may no longer be represented by BMI as their writers have indicated an intent to withdraw and change their representation to GMR.”
